We present asecond-personalaccount of corporate moral agency. This approach is in contrast to thefirst-personalapproach adopted in much of the existing literature, which concentrates on the corporation’s ability to identify moral reasons for itself. Our account treats relationships and communications as the fundamental building blocks of moral agency. The second-personal account rests on a framework developed by Darwall. Its central requirement is that corporations be capable of recognizing the authority relations that they have with other moral agents. We discuss the relevance (...) of corporate affect, corporate communications, and corporate culture to the second-personal account. The second-personal account yields a new way to specify first-personal criteria for moral agency, and it generates fresh insights into the reasons those criteria matter. In addition, a second-personal analysis implies that moral agency is partly a matter of policy, and it provides a fresh perspective on corporate punishment. (shrink)

Cutting a cake, dividing up the property in an estate, determining the borders in an international dispute - such problems of fair division are ubiquitous. Fair Division treats all these problems and many more through a rigorous analysis of a variety of procedures for allocating goods, or deciding who wins on what issues, when there are disputes. Starting with an analysis of the well-known cake-cutting procedure, 'I cut, you choose', the authors show how it has been adapted in a number (...) of fields and then analyze fair-division procedures applicable to situations in which there are more than two parties, or there is more than one good to be divided. In particular they focus on procedures which provide 'envy-free' allocations, in which everybody thinks he or she has received the largest portion and hence does not envy anybody else. Previous work has shown that memory performance in older adults is affected by activation of a stereotype of age-related memory decline. In the present experiment, we examined whether stereotype threat would affect metamemory in older adults; that is, whether under stereotype threat they make poorer judgments about what they could remember. We tested older adults (MAge= 66.18 years) on a task in which participants viewed words paired with point values and “bet” on whether they could later recall each word. If (...) they bet on and recalled a word, they gained those points, but if they bet on and failed to recall a word, they lost those points. Thus, this task required participants to monitor how much they could remember and prioritize high value items. Participants performed this task over six lists of items either under stereotype threat about age-related memory decline or not under stereotype threat. Participants from both groups performed similarly on initial lists, but on later lists, participants under stereotype threat showed impaired performance as indicated by a lower average point score and a lower average gamma coefficient. The results suggest that a modest effect of stereotype threat on recall combined with a modest effect on metacognitive judgments to result in a performance deficit. This pattern of results may reflect an effect of stereotype threat on executive control reducing the ability to strategically use memory. (shrink)

Schrift and Shannon SullivanThe articles in this special issue of the Journal of Speculative Philosophy were selected from revised versions of papers that were originally presented at the sixtieth annual meeting of the Society for Phenomenology and Existential Philosophy (SPEP) at Texas A&M University in College Station, Texas October 13–15, 2022.Michael Hardt of Duke University and Patricia Pisters of the University of Amsterdam gave the SPEP (...) 2022 Plenary Addresses, and we are grateful to be able to include their plenary papers in this special issue. Hardt's paper, "The Politics of Articulation and Strategic Multiplicities," treated SPEP members to an early peek at his newest book, The Subversive 70s (Oxford University Press, 2023). In this work, Hardt digs into the powerful resources for social movements that activists and theorists from the 1970s developed. As he argues, in many ways those activists and thinkers were ahead of their times—and also ahead of ours—in understanding how to analyze interwoven multiplicities of power and how to articulate and organize liberation struggles based on those multiplicities. Hardt brilliantly demonstrates how analyzing the progressive and revolutionary social [End Page 237] movements of the '70s can help us not only understand the roots of contemporary social and political struggles but also reclaim critical resources for those struggles.Patricia Pisters's paper, "Thinking with Fire: Elemental Philosophy and Media Technology," draws upon Gaston Bachelard's "fire complexes" to address a variety of pyrotechnical images appearing in contemporary cinema. Noting that elemental philosophy is on the rise in media studies and elsewhere, not least because of current environmental crises, fire is particularly engaging for its metaphorical, "matterphorical," and technological associations. While acknowledging fire as a material medium—cooking, heating, burning, etc.—Pisters's primary focus in her paper is on fire as an immaterial medium, and it is here that she turns to Bachelard's constellation of fire complexes—the Empedocles, Prometheus, and Novalis Complexes—to which she adds her own fourth complex, the Sita Complex. With these complexes, she provides readings of four cinematic productions that elucidate the annihilating, transgressive, sexual, and purifying qualities of fire, and she suggests that these entangled fire complexes present different kinds of combustive knowledge in which the element of fire manifests itself as material phenomenon of nature, the engine for modern life, and immaterial affective reverie of destruction, transgression, and sexuality.The other articles in this special issue have been organized according to five broad groupings. The first grouping, "On Latin American Philosophy," brings together three papers that engage Latin American philosophy, particularly as found in Mexican, Columbian, and Venezuelan history and political movements. In "Radicalizing Localization: Notes on Santiago Castro-Gómez's Genealogies of Coloniality," Julian Rios Acuña argues that Columbian philosopher Santiago Castro-Gómez develops a radical method of localization. This method allows Castro-Gómez to transform Foucauldian genealogy into genealogies of coloniality that grapple with the complexities of extreme violence produced by colonialism. In "Stefan Gandler's Renewal of Critical Theory from Latin America," Jake M. Bartholomew argues for a version of Critical Theory that is not bound by Europe but also remains true to its first-generation Marxist roots. Relocating to Mexico and advocating for Mexican philosophers, German-born philosopher Stefan Gandler shows how Latin American philosophy can enrich Critical Theory, providing more than can the second and third generations of Critical Theory because of its ability to analyze capitalism from outside the economic perspectives of the Global North. In "Two Versions of the Mestizo [End Page 238] Model: Toward a Theory of Anti-Blackness in Latin American Thought," Miguel Gualdron Ramirez criticizes the anti-Blackness that he sees at the heart of mestizo models of latinidad, or lo latinoamericano. Focusing on the concepts of liberation offered by Venezuelan theorist and politician Simón Bolívar and Mexican philosopher José de Vasconcelos, Ramirez reveals the exclusion and erasure of Black bodies, lives, and histories that ground their versions of Latinx identity and Latin American history. This paper explores the changes in cognitive function which occur as someone "loses consciousness" under anesthesia. Seven volunteers attempted a categorization task and a within-list recognition test while inhaling air, 0.2% isoflurane, and 0.4% isoflurane. In general, performance on these tests declined as the dose of anesthetic was increased and returned to baseline after 10 min of breathing air. A measure of auditory evoked responding termed "coherent frequency" showed parallel changes. At 0.2% isoflurane, subjects could still identify and respond to (...) category exemplars but showed impaired short-term memory function. Electrical stimulation at 0.4% isoflurane, intended to mimic the arousing effects of surgery, had a small, beneficial effect on performance. A mean of 63% of category exemplars was identified at this stage, but recognition memory for those exemplars was at chance on recovery. There was no evidence for learning of words presented at 0.8% isoflurane. (shrink)

Ghicago: University of Illinois Press, 1999. Pp. xviii + 246. Paper, $21.95.Since this work first appeared in 1971, Wolfgang Müller-Lauter has been at the forefront of German Nietzsche scholarship. The long (...) overdue appearance in English translation of this important work is a welcome addition to the Nietzsche literature and, although dated in some respects, it remains an important work that warrants careful attention. As Richard Schacht notes in his foreword, the original publication of this work was a significant event in the history of Nietzsche studies in Germany. Coming ten years after the publication of Heidegger's massive two-volume Nietzsche, Müller-Lauter's book "provided a much-needed counterweight" to Heidegger's idiosyncratic treatment (ix). Aside from proferring a significant rejoinder to the Heideggerian interpretation, Müller-Lauter also responds to a vast array of German Nietzsche scholars, some well-known (K. Löwith, K. Jaspers, E. Fink, K. Schlechta), but many much less familiar. As such, this book is an important piece of historical scholarship, offering the contemporary English-speaking reader an interesting picture of German scholarship on Nietzsche before Heidegger's work took center stage as the dominant (unfortunately, some would say only) German work worth engaging.But Müller-Lauter's book is not just of historical interest; it offers a powerful and profound reading of Nietzsche's corpus focused on the question of contradiction, both the contradictions readers find amidst Nietzsche's various works and Nietzsche's own philosophy of contradiction, namely, that contradictoriness is in some sense constitutive of the world. For Müller-Lauter, contradiction, the unresolvable conflict between essentially antithetical perspectives, grounds Nietzsche's philosophizing in wills to power. Emphasizing the plurality of conflicting wills to power, Müller-Lauter offers in successive chapters interpretations of Nietzsche's views on history as the "concrete occurrences" of these conflicting wills to power; nihilism as the process by which an organized system of forces (physical, social, intellectual, cultural) disintegrates into an antagonistic multiplicity of competing wills; morality as demanding truths that, once discovered, it can neither face nor accept, fleeing instead into a fictitious world of its own creation; Christian truthfulness as a destruction of truth that presents a "multiplicity of mutually opposing untruths" (72). All of these interpretations are shown to rest upon a contradiction at the heart of Nietzsche's own account of will to power, namely, that the strong will to power both affirms the multiplicity of perspectives and yet imposes its perspective as absolute.This is the paradox of the overman, a paradox Müller-Lauter addresses in his final chapter on "the doctrine of eternal recurrence." Not surprisingly, the eternal recurrence reveals itself to be essentially contradictory. But this contradiction is not self-refuting; rather "since the eternal recurrence is only as a thought and a doctrine, its meaning remains insurmountably split into a duality" (121) reflected in two ultimately incompatible types of overman. There is, on the one hand, the "powerful overman" who sees the entirety of what is as necessary for his own existence; to affirm eternal [End Page 453] recurrence is to understand everything that has been as a necessary series of events that ends with himself at its apex. But there is also the "wise overman," who understands the totality of what has been and is as necessary for his having arrived at the present moment in which he transcends himself and becomes other. Where the meaning of the powerful overman's affirmation of eternal recurrence resides in his appearance as the being who is dominant, the meaning of the wise overman's affirmation lies in understanding and accepting what has been as the precondition for both what he presently is and what he can become. This paper examines methodological issues associated with the theory of planned behaviour and explains that an alternative account of data used to support this theory can be provided by positioning theory. A case is presented that shows tests of the theory of planned behaviour fail to eliminate the possibility of alternative explanations for co-variation in its data. An agency or person-centered alternative shows how a causal interpretation can be reinterpreted as evidence of the actions of a person. Unlike the conceptualisation (...) of the individual as behaving in keeping with postulated underlying cognitive laws or rules we assume that the person has, through socialisation, acquired the skills necessary to initiate and manage their own actions. Unlike the interest in TPB data as a causal explanation of action we draw attention to the interpretation of patterns in these data as an aggregate of each person using a common mode of explanation to justify and explain their intentions. This article explains how data associated with attitude change and persuasion in mainstream psychology and social psychology can be reinterpreted as evidence of the agentive ability of taking a position. A critical review is made of the elaboration likelihood model and a position model is adapted from positioning theory. The postulates of the elaboration likelihood model are then subjected to critical scrutiny by means of comparison with our position model. In this way regularities associated with attitude change and persuasion are (...) interpreted as evidence of a deliberative process, involving negotiation and the use of supporting and opposing arguments. We present this as evidence of the commonly held agentive ability to position oneself and anticipate the positions of others. (shrink)

Though written corporate codes of ethics have been touted as a panacea for the embarrassments and uncertainties of the past two decades, the absence of clear evaluation procedures severely compromises their usefulness. An ethnographic study comparing development processes and compliance outcomes in large health care facilities and energy companies shows that neither of the two industries has encountered much success with a codes of ethics program. Companies that distribute copies of their code of ethics seldom ensure the process is completed (...) or that employees understand the purpose of the document, and staff responsible for the code give it a low priority relative to their overall responsibilities. Contrary to expectations, health care facilities are no more likely to develop or implement codes of ethics effectively than are energy companies. More extensive research is needed in order to generate the data necessary for the development of realistic standards for the evaluation of codes of ethics. (shrink)

1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)
